اختلاف عود الضمير في القرآن الکريم وأثره في الحکم الفقهي

بسم الله الرحمن الرحيم، إن المتأمل يجد کثيرا من الأحکام الفقهية جرى الخلاف فيها بين الفقهاء بناء على الاختلاف فى اللغة ومن ذلک اختلافهم في عود الضمير؛ فقد ترتب عليه اختلاف في الأحکام الفقهية.
اقتضت هذه الدراسة تقسيم البحث إلى : مقدمة ومبحثين وخاتمة ؛ احتوت المقدمة على أهمية البحث ، وأسباب اختياره ، والمنهج، والخطة.
وأما المبحث الأول ؛ فقد تناول فيه الباحث اختلاف عود الضمير في القرآن الکريم ، وأثره على اختلاف العلماء في العبادات
وأما المبحث الثاني:  فقد تکلم فيه الباحث عن اختلاف عود الضمير في القرآن الکريم ، وأثره في اختلاف العلماء في المعاملات.
ثم جاءت الخاتمة بها أهم النتائج والتوصيات، من أهم النتائج:
أولا – إن ارتباط الفقه بالنحو وثيق ، وقد بنيت کثير من المسائل الفقهية على الأوجه النحوية.
ثانيا – إن اختلاف عود الضمير في القرآن الکريم بين النحويين والمفسرين کان له أثر واضح في اختلاف الفقهاء .

In the name of Allah, the Most Gracious, the Most Merciful. The ‎meditator finds that there are many jurisprudence judgments in which ‎scholars have disagreed on the basis of the difference in language, ‎including their difference in pronoun's indication; It has resulted in a ‎difference in juristic judgments‏.‏
This study includes: introduction, two topics, and a conclusion. The ‎introduction contained the importance of the research, the reasons for ‎choosing it, the approach, and the plan‎‏.‏
And as for the first topic; the researcher discussed the difference of the ‎pronoun's indication in the Holy Quran, and its effect on the difference ‎of scholars in acts of worship. ‎
As for the second topic: the researcher spoke about the difference in the ‎pronoun's indication in the Noble Qur’an, and its effect on the ‎difference of scholars in transactions‏.‏
Then, the conclusion included the most important results and ‎recommendations. The following are examples of them:‎
First - The relationship of jurisprudence to grammar is close, and many ‎doctrinal issues have been built on grammatical aspects‏.‏
Second - The difference of the pronoun's indication in the Noble ‎Qur’an between grammarians and commentators has had a clear effect ‎on the variety of ‎‏ ‏jurist's opinions‏.‏
And may Allah’s prayers and peace be upon our master Muhammad ‎and his family and companions as a whole.‎
